Promotion Terms and Conditions

SPECIFIC TERMS & CONDITIONS

1. THE PROMOTION PERIOD

This promotion opens at 12am Monday 22 February 2021 and closes at 11.59pm Sunday 9 May 2021. Entries must be received during this time in order to qualify for the prize draw.

2. THE PRIZE

5 x footy lounge packages (1 per Super Rugby Team) with each package comprised of the following:

The total value of each prize pack is $10,859.00 based on the RRP as at 15/02/2021. The total prize pool value is $54,295.00 based on the RRP as at 15/02/2021.

3. HOW TO ENTER

To validly enter the draw you must:

(a) Enter within the promotion period as outlined in section 1 (22 February 2021 – 9 May 2021 inclusive)

(b) Submit your correct details to the promotion entry page: www.smithscity.co.nz/win-with-super-rugby.

a. For a valid entry you must provide your first name, last name, email address, and select your preferred Super Rugby Aotearoa team

(c) Be 18 years old or older at the time you submit your details

(d) Be a New Zealand resident (for tax purposes) at the time of the draw

(e) Not be an employee or the immediate family member of an employee at Smiths City.

Entry is limited to one entry per person. If multiple entries are received for any one person, the first entry will be deemed the valid entry.

4. WINNER SELECTION

Five winners will be selected from the overall pool of valid entrants at random on 10th May 2021.

One winner will be drawn for each Super Rugby Aotearoa team at random from the valid entries received by Smiths City. Entries submitted for each Super Rugby Aotearoa team will be determined by the selection of a Super Rugby Aotearoa team that was made by the entrant at the time of entry.

In the event that a winner cannot be contacted within 48 hours, a new winner may be drawn and the original drawn winner will forfeit any claim to the prize. Smiths City is not obliged to attempt to contact you more than once or other than by the contact details you supplied.

If you are a drawn winner you must be available to have the prize delivered to you at a time that’s mutually agreeable. Prizes cannot be exchanged or refunded for cash without Smiths City express permission which it may grant or withhold in its sole discretion.

5. PRIZES

Each winner will receive a Super Rugby Lounge Package from Smiths City as described in the Prize package in 1a) and will be the items listed in the terms and conditions. Smiths City reserves the right to swap out the products to the same value or greater value.

6. CHANGES TO THESE TERMS

Smiths City reserves the right to cancel this competition and to update the terms & conditions without notice.

7. PUBLICITY

Entry into a draw gives Smiths City consent to use your name and photograph for any publicity associated with this promotion.

8. LIABILITY

Smiths City’s sole obligation under these terms is to conduct the prize draws and award the prizes as described. You acknowledge that Smiths City has no liability to you in respect of these draws and to the maximum extent permitted by law Smiths City excludes any liability it may owe to you, however arising.

GENERAL TERMS & CONDITIONS

The Promoters are Smiths City 2020 Ltd. and Smiths City Finance Ltd., 261 Opawa Road, Hillsborough, Christchurch.

Participation in the Promotion constitutes acceptance of these and the Specific Terms and Conditions.

The Promotion is governed by New Zealand law.

Entrants must be aged 18 years or over and a resident of New Zealand.

The Prize is not transferable, exchangeable or negotiable and is not redeemable for cash.

By entering, the Winner agrees to accept their prize in-person from the participating Smiths City location and to be available for reasonable publicity purposes without compensation, including but not limited to photographs and interviews if requested. Entrants acknowledge that their details may be published in various media.

Entries that are illegible, incomplete or do not comply with these Terms are invalid.

The Promoters reserve the right, at any time, to verify the validity of entries and entrants as required (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.

The Promoters reserve the right to request the Winner provide suitable identification of proof of age and identity prior to awarding the Prize.

The draw for any unclaimed Prize will take place at the offices of Smiths City (2020) Ltd, 261 Opawa Road, Hillsborough, Christchurch.

The Winner of the unclaimed Prize draw will be contacted by email. The Winner’s name may be published on our website smithscity.co.nz, Smiths City Facebook page and any participating supplier's website or Facebook page.

The Promoters and any participating Suppliers reserve the right to announce and/or publish the Winners name and/or photograph for publicity purposes.

The Winner’s name may be published on our websites smithscity.co.nz and smithscityfinance.co.nz, our Smiths City Facebook page, and any participating supplier's website or Facebook page.

The Promoters and any participating Suppliers may at their absolute discretion, suspend, cancel or recommence the Promotion if:

• for any reason the Promotion is not capable of proceeding as planned;
• the Promotion is corrupted or the administration, security, fairness, integrity or proper conduct of the Promotion is affected; or
• if the determination of the winners or delivery of prizes is prevented or hindered by any event outside the Promoters control subject to approval by relevant regulatory authorities.
• Except for any liability not excluded by law, entrants release and indemnify the Promoters and any participating Suppliers from and against all actions, claims and liabilities, that the entrant now has or in the future may have against the Promoters and any participating Suppliers for any loss, damage or injury (including any special or consequential loss) suffered as a direct or indirect result of the Entrant's participation in the Promotion.

The Promoters’ decision in relation to this Promotion is final and binding on entrants and the Promoters will not enter into any correspondence.

By entering the Promotion, Entrants consent to their personal information being used by the Promoters, any participating Suppliers and/or its related entities for the purpose of conducting this Promotion, notifying the Winners and distributing Prizes. All personal details of the entrant will be stored at the offices of the Promoters. A request to access, update or correct any information should be directed to that office.

Employees, contractors and immediate families of employees and contractors of the Promoters, their related entities and any other organisations associated with this Promotion are ineligible to enter.
